Sam and her co-presenter, Christopher A. Wilson of Holland & Knight LLP, will explore the structure and foundational principles of state income tax. This session will provide an introduction or refresher of a wide variety of issues related to state income tax.
“General Mercantile: Knowing What You are Buying and Selling, and How Not to Get Whipsawed on Audit”

In this breakout session, Sam and her co-speaker, John F. Fletcher of Jones Walker LLP, will discuss practical approaches for determining whether to classify a product as a sale of tangible personal property or a sale of service. They will present situations involving products with substantial service and tangible personal property components, as well as how to determine whether tangible personal property is consumed when rendering a service.
They will also go in-depth on products offered “as a service,” as well as more traditional product offerings. Sam and John will offer proactive strategies you can employ to limit exposure in the event of an audit and potential defenses to raise during audit.
