Jordan will participate in a mock trail as the attorney for a business that is being audited in an unclaimed property audit. The defense of the “holder” will include both statutory and constitutional issues. Among the many defenses to be raised will be the statutory right for a third party to conduct an audit on behalf of the state under a contingency of per hour fee arrangement and the ability of a state to audit books and records going back over fifteen years. Unclaimed property audits are becoming common place at a tremendous cost to all businesses both in resources and ultimate liabilities.
