Client Success: Lindenmeyr Munroe Obtains $1M Judgment Plus 5% Prejudgment Interest Per Annum

HMB assisted its client, Central National Gottesman, Inc. d/b/a Lindenmeyr Munroe ("LM") in obtaining a judgment against J.S. Paluch, Inc. in the amount of $1,013,476.19 plus 5% prejudgment interest per annum.

HMB initiated litigation on behalf of Lindenmenyr Munroe in late 2019 seeking judgment in its favor for unpaid invoices and breach of a promissory note. The complaint alleged two causes of action: breach of contract and account stated. J.S. Paluch filed affirmative defenses alleging, among other things, repudiation of the note and rescission of the note, as well as two counterclaims seeking a declaration from the court that the note and its related UCC-1 financing statement are invalid.

HMB filed a Motion for Summary Judgment in late 2020 on behalf of Lindenmeyr Munroe. After briefing and consideration by the Court, Judge Andrea Wood of the Federal District Court for the Northern District of Illinois, Eastern Division granted judgment in favor of Lindenmeyr Munroe on its cause of action for breach of contract (denying the claim for account stated as it was duplicative) and on both counterclaims filed by J.S. Paluch.
